The protection of personal data and compliance with the relevant data protection regulations - currently Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - "GDPR") and the Data Protection Act 2018, as amended ("DPA 2018"), as well as the legal acts adopted on the basis thereof - have the highest priority at Neuson Hydrotec. In accordance with Art. 12 and 13 GDPR, this data protection information provides an overview of which data is processed by Neuson Hydrotec for which purposes and how Neuson Hydrotec ensures the protection of this data.

Neuson Hydrotec processes (see Art. 4 Z 2 GDPR) personal data ("data") of natural persons ("data subjects" or individually gender-neutral "data subject") within the meaning of Art. 4 Z 1 GDPR in the context of its business, in particular in the operation of its website.

This data protection information can be accessed electronically, printed out, downloaded and saved on a storage medium at any time on the website of Neuson Hydrotec https://www.neuson-hydrotec.com ("Website").

The terms used in this data protection information are to be understood as defined in Art. 4 GDPR.

Responsible party, data protection officer

Neuson Hydrotec (see point 1.1.) is the controller within the meaning of Article 4(7) GDPR.

As the requirements of Art 37 (1) GDPR are not met, in particular the core activity of Neuson Hydrotec does not consist of carrying out processing operations which, by their nature, scope and/or purposes, require extensive, regular and systematic monitoring of data subjects, Neuson Hydrotec has not appointed a data protection officer.

Processing of personal data in general

Neuson Hydrotec processes (see Art 4 Z 2 GDPR) personal data ("data") of natural persons ("data subjects" or individually gender-neutral "data subject") within the meaning of Art 4 Z 1 GDPR in the context of its business, in particular in the operation of its website.

The term "data subject" includes all categories of persons affected by data processing. These include, in particular, visitors to the website, interested parties and contact persons ("customers"), contractual partners and their contact persons, job applicants and employees ofNeuson Hydrotec.

Neuson Hydrotec processes data only in compliance with the principles laid down in Art. 5 et seq. of the GDPR and only if at least one lawfulness condition within the meaning of Art. 6 of the GDPR is met. The purpose and duration of processing are regulated by category in point 4.

Neuson Hydrotec does not process special categories of personal data within the meaning of Art 9 (1) GDPR ("sensitive data"). Neuson Hydrotec only processes sensitive data if a case of Art. 9 para. 2 GDPR exists.

If necessary, i.e. if no other lawfulness condition listed in Art. 6 GDPR or - in the case of sensitive data - no other case of Art. 9 para. 2 GDPR is fulfilled (or as a precautionary measure in addition thereto), Neuson Hydrotec will obtain the consent of the data subjects. If data subjects voluntarily disclose data not required byNeuson Hydrotec (e.g. in job applications), they thereby give their express consent to the processing of this data by Neuson Hydrotec. Data subjects have the right to revoke any consent given in whole or in part at any time. The revocation must be sent to Neuson Hydrotec(for contact details see point 1.1.). Although the revocation of consent is not bound to any specific form, it is recommended to declare the revocation in text form (e.g. letter, e-mail or fax) for verification purposes. The withdrawal of consent does not affect the processing of data on the basis of other conditions within the meaning of Art. 6 para. 1 GDPR or - in the case of sensitive data - another case of Art. 9 para. 2 GDPR or the lawfulness of the processing carried out on the basis of the consent until the withdrawal.

Disclosure, transmission or transfer of data by Neuson Hydrotec only takes place insofar as this is permitted or required by the applicable legal provisions. The categories of recipients to whom Neuson Hydrotec discloses data are - apart from the category-related recipients listed in point 4 - in particular the processors listed in point 16 in accordance with Art 28 GDPR, authorities and courts and, in the case of debt collection measures, debt collection agencies and lawyers. Without consent, Neuson Hydrotec does not transmit any data to recipients in a non-EU member state or to international organizations. Within the company of Neuson Hydrotec, the organizational units and employees receive the data they need to perform their duties.

Collection and processing of data from the data subject

Neuson Hydrotec processes personal data exclusively on one of the following legal bases:

  • Your consent
  • On a contract basis
  • To fulfill legal obligations
  • in the legitimate interest

Data is processed on the website exclusively on the basis of the statutory provisions (GDPR, DSG 2018, TKG 2021).

Data processing (web store, product reviews and user account) is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and for contract fulfillment in accordance with Art. 6 para. 1 lit. b GDPR.

If analysis tools are used, the data is used on the basis of our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. The legitimate interest in the use of data is the improvement of the website and the measurement of the success of online advertising.

The use of IT data security measures is based on our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. The legitimate interest in the use of data is to secure our own IT systems and to protect your data.

The use of social media plugins is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR.

Processing of data when visiting the websites

When visiting the websites, necessary (technical) data (access data within the meaning of point 7. and cookies within the meaning of point 8.) of the website visitors are collected and processed for the operation, security and optimization of the websites on the basis of the legitimate interests of Neuson Hydrotec (in accordance with Art 6 para 1 lit f) GDPR (see points 7. and 8.).

Processing of data when expressing interest in offers from Neuson Hydrotec and when contacting Neuson Hydrotec

When expressing interest in offers from Neuson Hydrotec and when making contact with Neuson Hydrotec data of persons interested in offers from the Neuson Hydrotec and by contacting parties (in particular via the websites) on the basis of Art. 6 para. 1 lit. b) GDPR (implementation of pre-contractual measures) for the purpose of sending targeted offers and processing inquiries. The following data categories are processed: Access data, master data, contact data and correspondence/communication/content data. The data of interested parties and contacting persons are stored in order to process the offer or inquiry and to answer any follow-up questions and are deleted after the storage period has expired.

Processing of data when ordering in the online store

When ordering in the online store, Neuson Hydrotec collects and processes the data necessary for the purpose of fulfilling the contract, in particular access, master, contact, correspondence/communication/content, order/contract, invoice and bank/account/payment data, on the basis of Art. 6 para. 1 lit. b) GDPR and the data to be collected in accordance with the applicable legal provisions (also) on the basis of Art. 6 para. 1 lit. c) GDPR. The data will be processed and stored for as long as is necessary for the fulfillment of the contractual relationships (including post-contractual obligations) and for legal (in particular VAT) reasons.

If this is necessary for the purpose of fulfilling the contract, customer data will also be passed on to the vicarious agents of Neuson Hydrotec involved in the processing of the contractual relationship and to contractual partners not attributable to Neuson Hydrotec on the basis of Art. 6 para. 1 lit. b) GDPR.

The storage period is the duration of the contractual relationship (including post-contractual obligations).

Processing of data when sending e-mail newsletters

If Neuson Hydrotec sends e-mail newsletters within the meaning of point 15, it collects and processes the e-mail address of subscribers to e-mail newsletters only on the basis of consent pursuant to Art. 6 para. 1 lit a) GDPR and stores it until the subscribers have unsubscribed (see point 15).

Processing of data for the purpose of direct marketing

If Neuson Hydrotec receives the e-mail address of data subjects in connection with a sale or service, it is entitled to send direct advertising by e-mail in the form of information and mailings for its own or similar products and services on the basis of its legitimate interest pursuant to Art. 6 para. 1 lit. f) GDPR. Data subjects have the right to object to the processing of data concerning them for the purpose of such advertising at any time (in particular also during the transmission of e-mails) (see point 18.8.).

The storage period is the duration of the interest pursuant to Art. 6 para. 1 lit. f) GDPR

Processing of data from job applicants

Neuson Hydrotec collects and processes master data, contact data, correspondence/communication/content data as well as data on the education and professional experience of job applicants on the basis of Art. 6 para. 1 lit. b) and c) GDPR. Sensitive data voluntarily provided by job applicants in the application will be processed on the basis of Art. 9 para. 2 lit. a) GDPR.

Processing of employee data

Furthermore, master, contact, correspondence/communication/content data as well as employment contract, personnel administration and payroll data of employees are collected and processed on the basis of Art. 6 para. 1 lit. b) and c) GDPR as well as sensitive data of employees required under labor and social law regulations (e.g. sick notes) on the basis of Art. 9 para. 2 lit. a) and lit. c) GDPR. Insofar as this is necessary for the purpose of fulfilling the employment contract or for legal reasons, employee data is also passed on to chambers, interest groups and trade unions on the basis of Art. 6 para. 1 lit. b) and c) GDPR. Employee data is also processed and stored for as long as this is necessary for the fulfillment of contractual relationships (including post-contractual obligations) and for legal (in particular social security) reasons.

The storage period is the duration of the contractual relationship (including post-contractual obligations).

Collection of data from third parties

Neuson Hydrotec does not process any data that is not collected from data subjects themselves, with the exception of necessary technical access data in accordance with point 7. when accessing the websites and data collected by necessary cookies in accordance with point 8.

Your personal data will not be transferred to third parties for purposes other than those listed below. We only pass on your personal data to third parties if:

  • you have given your express consent in accordance with Art. 6 para. 1 lit. a GDPR,
  • the disclosure pursuant to Art. 6 para. 1 lit. f GDPR is necessary to safeguard operational interests, as well as for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that there is a legal obligation for disclosure pursuant to Art. 6 para. 1 lit. c GDPR and
  • this is legally permissible and in accordance with Art. 6 para. 1 lit. b GDPR for the processing of
  • contractual relationships with you.

The controller may disclose your personal data to suppliers who provide services on our behalf in accordance with our instructions.

The controller may also pass on your personal data to our affiliated companies and partners.

In addition, the controller may disclose your personal data if we are required to do so by law, regulation or governmental authority or if we believe that disclosure is necessary or appropriate to prevent physical harm or financial loss.

The controller reserves the right to transfer any personal data we hold about you if we sell or transfer all or part of our business or assets (including in the event of a reorganization, dissolution or liquidation).

Duration of data processing, retention and storage period

Neuson Hydrotec does not process and store data permanently, but only in accordance with the time limits prescribed by the applicable legal provisions, and in any case for as long as is necessary for the purposes for which the data were collected. Neuson Hydrotec stores data in a form that enables the identification of data subjects only for as long as is necessary for the purposes for which they are processed.

The respective retention or storage period of data is regulated by category in point 4. In the case of existing contractual relationships, the corresponding data - subject to any further legal obligations - will be processed and stored for as long as is necessary for the fulfillment of the contractual relationships (including post-contractual obligations).

If data is only processed on the basis of consent (see point 3.5.), this data will be deleted immediately following withdrawal of consent by the data subject in accordance with Art. 7 para. 3 GDPR and will not be processed (any further). The same applies in the event of a justified objection in accordance with Art. 21 GDPR, if data is only processed on the basis of our legitimate interest in accordance with Art. 6 para. 1 lit. f) GDPR.

The controller may also transfer your personal data to countries outside the country in which the information was originally collected. These countries may not have the same data protection laws as the country in which you originally provided the personal information. If we transfer your information to other countries, we will protect that information as described in this Privacy Policy and such transfers will be governed by applicable law.

The countries to which we transfer the personal data are located

  • within the European Union or
  • outside the European Union

If we transfer personal data from the European Union to countries or international organizations outside the European Union, the transfer takes place on the basis:

  • of an adequacy decision by the European Commission;
  • In the absence of such, for other legally permissible reasons such as the existence of a legally binding and enforceable document between the authorities or public bodies, binding internal company rules, standard data protection clauses and approved or certified codes of conduct.

In exceptional cases, data may also be transferred on the basis of Art. 49 GDPR:

  • Art. 49 para. 1 lit. a GDPRthedata subject has expressly consented to the proposed data transfer after having been informed of the possible risks of such data transfers for him/her without the existence of an adequacy decision and without appropriate safeguards,
  • Art. 49 para. 1 lit. b GDPRthetransfer is necessary for the performance of a contract between the data subject and the controller or for the implementation of pre-contractual measures at the request of the data subject,
  • Art. 49 para. 1 lit. c GDPRthetransfer is necessary for the conclusion or performance of a contract concluded by the controller with another natural or legal person in the interest of the data subject.

Collection of access data when using the websites

Persons can visit the websites without providing any personal data. As part of the operation of its websites, Neuson Hydroteconly collects and processes data of a technical nature about each access to the websites, which are processed automatically when accessing them and which are considered personal data or could be used to identify the person or personal data of data subjects and which are stored in so-called server log files ("access data"). This includes the IP address, unique device identification, type and version of the operating system and browser, file name and path, type of transmission protocol, date and time of access, bytes transferred, referrer URL (previously visited page) and the requesting provider.

However, Neuson Hydrotec does not process this access data for the purpose of identifying the person or determining other personal data of the data subject, but exclusively for the purpose of operation, needs-based design, adaptation, improvement, maintenance, optimization and further development of the websites (including functions, services, modules and features) as well as for error detection and correction, for maintaining system security and - if web analysis tools are used - for the purpose of internal statistical evaluation, without drawing conclusions about the person of the data subject. There is also no profiling.

Cookies

Cookies are files that are stored locally in the cache of the website visitor's Internet browser and are used in particular to offer additional functions on the websites, to make them more user-friendly, effective and secure by recognizing the accessing Internet browser and by storing temporary files and - if web analysis tools are used - to enable an (anonymized) analysis of the use of the websites.

Cookies that are absolutely necessary for the functioning of the websites are used on the basis of the legitimate interests of Neuson Hydrotec pursuant to Art. 6 para. 1 lit. f) GDPR in the operation, security and optimization of the websites. Any other cookies are processed on the basis of consent pursuant to Art. 6 para. 1 lit. a) GDPR, which data subjects can give by actively clicking on a tick box when visiting the websites. Data subjects have the option of withdrawing their consent at any time by deactivating and/or deleting cookies in the settings of their internet browser and specifying how long they are stored and when they are deleted. The procedure for doing so depends on the Internet browser used by the data subject. However, non-acceptance and deactivation of cookies may result in certain functions and/or content of the websites not working or not working as expected.

Session cookies are stored temporarily for the duration of access by the data subject and deleted after the browser is closed; persistent cookies remain stored on the data subject's end device until they remove them from their browser.

Online store, user account

Neuson Hydrotec operates an online store on its websites, where data subjects can optionally create a user account, which - after logging in - allows them to access information and documents online in the closed area (login area) and/or communicate with Neuson Hydrotec.

To register for the online portal, the following data must be provided: country, first name and surname, address/address, date of birth, e-mail address, telephone number, password. The data provided for the purpose of ordering will be used by Neuson Hydrotec to fulfill and process the contract. The data will be treated confidentially, transmitted in encrypted form and not passed on to third parties who are not involved in the ordering, delivery and payment process.

After successful registration, a user account is opened for the data subject. The registered data subject can then access the login area of the online store at any time by entering their login data (e-mail address and the password they have chosen) and manage their personal data there under the "Settings" menu item. As part of the registration and renewed logins as well as use of the online portal, Neuson Hydrotec stores the IP address and the times of the respective accesses by the data subject.

The user accounts are not public and cannot be indexed by search engines. Data subjects can request Neuson Hydrotec to delete their user account at any time. In this case, all data relating to the user account will be deleted, unless and insofar as their retention is necessary for contractual or legal reasons. It is the responsibility of the person concerned to back up their data before deleting the user account. Inactive user accounts will be deleted by Neuson Hydrotec after 7 years.

Integration of third-party services and content (third-party tools)

Neuson Hydrotec also uses plugins from third-party providers on its websites in order to integrate their content and services (such as videos). However, such plugins are only called up on the basis of consent in accordance with Art. 6 para. 1 lit. a) GDPR, which the data subjects can give by actively clicking on a tick box. If data subjects consent to such plugins being accessed, a connection is established to the servers of the third-party provider and the corresponding plugin is accessed. The content of the plugins is transmitted directly to the data subject's browser by the respective third-party provider. By accessing the plugins, the third-party providers receive the information that the data subject's browser has accessed a website of Neuson Hydrotec, even if the data subject is not registered with the relevant third-party provider or is not currently logged in. The plugin transmits log data to the respective servers of the third-party providers. This log data contains the following data IP address, the address of the websites visited, which also contain plugin functions, type and settings of the browser, date and time of the request, the way the plugin is used and cookies.

The processing of the data by the third-party providers takes place within the framework of the respective data protection provisions of the third-party providers. As the operator of the websites, Neuson Hydrotec has no knowledge of the content of the data transmitted to the third-party providers or their processing. Third-party providers may in any case use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. In addition, pseudonymous information may be stored in cookies on the data subject's device and may contain, among other things, technical information on the browser and operating system, referring websites, visiting time and other information on the use of the websites of Neuson Hydrotec, as well as being linked to such information from other sources.

If the data subject is registered with the third-party providers and logged into user accounts of the third-party providers, the third-party provider can personally assign the user behavior to the data subject. The data subject can prevent this by logging out of their user account beforehand. If a data subject is not a member of the third-party provider, the third-party provider can still obtain and store certain data (see point 13.1.).

Apart from not giving their consent, data subjects can completely prevent the plugins from loading with add-ons for their browser, e.g. with the script blocker "NoScript" (http://noscript.net/). In addition, reference is also made once again to the possibility of deactivating cookies (see point 8.2.).

Some of the third-party providers are certified under the Privacy Shield Agreement and thus guarantee compliance with the European level of data protection, such as Google (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active) and Facebook (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

E-mail newsletters and electronic notifications

Neuson Hydrotec sends e-mail newsletters and electronic notifications with advertising information only on the basis of consent pursuant to Art. 6 (1) (a) GDPR. To subscribe to the e-mail newsletter, it is sufficient to provide an e-mail address.

Registration for the e-mail newsletter takes place in a so-called double opt-in procedure, i.e. after registering for the e-mail newsletter, the data subject receives an e-mail in which they are asked to confirm their registration. This confirmation is necessary so that no one can register with someone else's e-mail address. Registrations for the email newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the IP address and the time of registration and confirmation. Changes to the stored data are also logged.

Email newsletters and electronic notifications are sent by the sending service provider and processor "Sendinblue", an online marketing platform. The email addresses of the data subjects are stored on Sendinblue's servers in the EU. The Sendinblue uses this information to send emails on behalf of Neuson Hydrotec. Furthermore, Sendinblue declares that it complies with the requirements of the GDPR. The Sendinblue privacy policy can be found at the following link: https://www.brevo.com/de/legal/privacypolicy/.

In the case of registration for an e-mail newsletter, the e-mail and registration data and the IP address of the data subjects are processed and stored until they unsubscribe from the newsletter. The data processed after registration, namely the emails sent to the data subjects, whether and when they were opened or blocked or marked as spam, whether they could not be delivered temporarily or permanently and the links clicked on are stored for a period of 12 months and then deleted.

Data subjects can unsubscribe from the e-mail newsletter at any time, i.e. revoke their consent. A link to unsubscribe from the e-mail newsletter can be found at the end of each e-mail.

Whistleblower system

Neuson Hydrotec attaches great importance to responsible corporate governance and is guided by the principles of integrity, honesty and transparency. Our commitment to our contractors is to ensure the highest standards of quality, safety and sustainability at all times.

We firmly believe that adherence to these ethical standards will continue to help maintain successful long-term relationships with our business partners and employees. However, should you become aware of any behavior or circumstances that you consider to be misconduct or wrongdoing while working with Neuson Hydrotec, we encourage you to report it to us.

Use our Neuson Hydrotec Integrity Line for this purpose. Reports can be made completely anonymously.

Data processing on behalf of Neuson Hydrotec

If data is processed on behalf of Neuson Hydrotec, it only works with processors within the meaning of Art. 4 (8) GDPR who offer sufficient guarantees that suitable technical and organizational measures are implemented in such a way that the processing is carried out in accordance with the existing legal provisions and the protection of the rights of the data subjects is guaranteed. For this purpose, Neuson Hydrotec concludes appropriate contracts with its processors that meet the requirements of Art 28 GDPR and complies with Art 44 ff GDPR for processors based in third countries.

Processors of Neuson Hydrotec are currently:

Security of data processing

Neuson Hydrotec takes appropriate and suitable technical and organizational measures for the security of data and data processing, taking into account the criteria of Art 32 GDPR, and ensures that the data is protected against unauthorized or unlawful processing and against loss, damage and alteration.

Rights of data subjects

Neuson Hydrotec safeguards the rights of data subjects in accordance with the applicable legal provisions. According to the current legal situation, the data subjects are entitled to the (abstract) rights listed below. The data subjects can assert their rights by sending an appropriately specified request - preferably in text form (e.g. letter or e-mail) - to Neuson Hydrotec (for contact details see point 1.1.). If the applicable legal provisions stipulate deadlines for the execution of the request, Neuson Hydrotec will comply with these deadlines.

Right to confidentiality

Neuson Hydrotec respects the fundamental right of the data subject to data protection in accordance with Section 1 (1) DSG 2018 and the right to data secrecy in accordance with Section 6 DSG 2018.

Right of access and information

Under the conditions and in accordance with Art. 13 to 15 GDPR, the data subject has the right to information about the processing of their data by Neuson Hydrotec and about their rights.

Right to rectification and completion

Under the conditions and in accordance with Art. 16 GDPR, the data subject has the right to rectification of inaccurate and completion of incomplete data concerning him/her.

Right to erasure

Under the conditions and in accordance with Art. 17 GDPR, the data subject has the right to demand the immediate deletion of data concerning him/her.

Right to restriction of processing

Under the conditions and in accordance with Art. 18 GDPR, the data subject has the right to request the restriction of the processing of their data.

Right to data portability

Under the conditions and in accordance with Art. 20 GDPR, the data subject has the right to receive the data concerning him or her, which he or she has provided to Neuson Hydrotec , in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller or to have Neuson Hydrotec transmit the data processed directly to another controller, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

Right of objection

Under the conditions and in accordance with Art 21 GDPR, the data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on Art 6 (1) (e) or (f) GDPR. In the event of a justified objection, Neuson Hydrotec will no longer process the data of the data subject affected by the objection, unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defense of legal claims. If the data subject objects to processing for direct marketing purposes, their data will no longer be processed for these purposes.

Right not to be subject to an automated decision

Under the conditions and in accordance with Art. 22 GDPR, the data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

Right of withdrawal

Pursuant to Art. 7 (3) GDPR, the data subject has the right to withdraw their consent to the processing of data concerning them at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Right to complain

Pursuant to Art. 77 GDPR in conjunction with Section 24 DSG 2018, the data subject has the right to lodge a complaint with the competent supervisory authority (data protection authority), without prejudice to any other administrative or judicial remedy.

Pursuant to Art. 79 GDPR in conjunction with Section 27 DSG 2018, the data subject has the right to an effective judicial remedy against a legally binding decision of the supervisory authority concerning him/her (right of appeal to the Federal Administrative Court), without prejudice to any other administrative or extrajudicial remedy.
